1. Peach and Cream is a duly registered Quebec company operating under the name Peach and Cream Products Inc and 9469-5418 Quebec inc. The business address of our company is located in Quebec, but our products are made available throughout Canada and the United States. However, we only provide online products;

2. These Terms and Conditions are made in accordance with the law of the province of Quebec in Canada;

3. This page complements the other informative pages (Refund Policy and Guarantees, Confidentiality Policy and Privacy Policy);

4. Please read these Terms and Conditions carefully before making any purchase or subsequent order or transmitting any personal information concerning you, these terms and conditions taking effect as soon as you become a Customer by placing an order for products online. Be sure to understand them;

5. All products posted on the website are available unless otherwise stated;

6. By placing an order, you agree to the application of these Terms and Conditions and a contractual relationship is established between you and us;

7. To be able to place an online order, the minimum age required is eighteen (18) years. You declare that you are of the required age by ordering any product available online. We reserve the right to cancel any order if any misrepresentation of your age is discovered;

10. If you are a Canadian consumer (other than Quebec) or an American consumer, the rules may be different, please read the Refund Policy and Guarantees of the Peach and Cream store for more information;

11. Peach and Cream undertakes to respect the legal rules in this matter;

12. Consult our Privacy Policy and the rules we put into practice regarding the protection of your privacy and your personal information;

13. Peach and Cream undertakes to respect this policy with regard to the conservation of your personal information collected at the time of your purchase and for the future, including by specifying that no transmission of your information to third parties will be made without your prior agreement;

14. Peach and Cream takes the risk of fraud seriously and has done everything in its power to avoid it by securing its website which collects personal information about you or which allows you to accept your payments online. Your connection to our company is secure;

force majeure

18. Peach and Cream cannot be held liable for non-compliance with delivery times or the performance of the contract in the event of force majeure. For the purposes of these terms, force majeure is defined as an unforeseeable event or a fault committed by a third party (natural or legal person);

19. In this case, the Refund Policy and guarantees may not apply;

20. We invite you to contact us for any problem encountered in connection with your purchase with our company. You will find our contact details on the website;
Additional terms

21. Your rights under these terms may be transferred to another person with the permission of Peach and Cream. Without this authorization, the consumer who pays for the product online, therefore who has concluded the online purchase contract, is the one to whom belongs the right to assert these terms and conditions;

22. A refund request can be made to Peach and Cream however according to certain requirements given the nature of the products sold no cancellation will be possible it is the product or products have been opened and or used;

23. Reimbursement is conditional on the return of the unsatisfactory product(s);

24. The timeframe for receiving a refund may vary depending on where you had the product(s) delivered or where you want to return from;

25. Any refund request must be substantiated and must include one or more photos of the products concerned as well as a copy of your purchase confirmation;

Modification of these Terms and Conditions;
26. Peach and Cream reserves the right to modify these Terms and Conditions, in particular with the aim of ensuring that the general conditions comply with the laws in force. If you are a customer then you will receive a notification that the terms and conditions have changed. This notification will always indicate the effective date of these changes;

Mobile Terms of Service

The Peach and Cream mobile message service (the "Service") is operated by Peach and Cream (“Peach and Cream”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Peach and Cream’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Peach and Cream through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Peach and Cream. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18449394305 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Peach and Cream mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
